IN. MINNESOTA <br /> ; <br /> WHEREAS certain areas of the City of New Brighton are subjec~ <br /> to periodic flooding from Rice Creek and its tributaries, and <br /> WHEJ:U!:ASrelief.is available in the form of flood insu;::ance <br /> as author~zed by the National Flood Insurance ACt of 1968 as <br /> amended; apd <br /> WHEREZ-\S, it' is the intent -of this City Council to comply with <br /> land use and management criteria regulations as required in said <br /> act~ and ,,' ' <br /> WHEREAS it is also the intent of this City Council to <br /> recognize and duly evaluate flood hazards in all official <br /> actions relating to land use in the flood plain areas having <br /> s]?ecial ,flood hazards, and <br /> WHEREAS the ,Code Citation(s) of State enabling legislation <br /> _ and of any-resulting local ordinance that authorized this <br /> community to adopt land use and control measures are: Minn. <br /> Statutes Sections 394!01 et ~ and Minn. Statutes 462.351-462.363 <br /> (c;i.ti;.es, villages, boroughs): Minn. statutes, C.i04 (Flood Plain <br /> Management Act); 'Section 475.00 New Brighton City.
