RESOLUTION NO. 1633 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION AUTHORIZING AND DIRECTING CITY ATTORNEY TO SETTLE <br /> LAWSUIT RELATING TO DEFECTIVE TENNIS COURTS <br /> WHEREAS the City of New Brighton has brought suit against <br /> Brauer and Associates, Inc. for damages due to defective design <br /> and construction of tennis courts in Hansen Park, and <br /> WHEREAS settlement of this litigation is proposed and <br /> recommended whereby the defendant will pay the sum of $6,000 to <br /> the City of New Brighton, and <br /> WHEREAS such proposed settlement appears to be fair and <br /> reasonable and in the best interests of the City of New Brighton <br /> NOW THEREFORE BE IT RESOLVED, That the City Attorney is <br /> hereby authorized and directed to settle the p~nding suit <br /> against Brauer and Associates, Inc. for the sum of $6,000 in <br /> accordance with the Settlement Stipulation attached hereto and <br /> made a part hereof. <br /> BE IT FURTHER RESOLVED, That the proceeds ~f such <br /> settlement are hereby encumbered for expenditure under the <br /> Capital Improvement Plan for tennis facilities. <br /> Adopted this 28th day of October, 1975. <br /> ., ATTEST: <br /> ,~Te,~a~j <br /> Vernon C.
