School does by this Agreement grant to the City of New <br /> Brighton permission and license to install the outside <br /> rest rooms and the outside lighting with the understanding <br /> that all such equipment remain the personal property of <br /> the City of New Brighton and that the City has the right <br /> upon the termination of this Agreement or any extension <br /> thereof to remove such personal property from the premises. <br /> 5. City assumes the responsibility for the operation of the <br /> ice skating rink and warming facility associated therewith <br /> . <br /> for the hours of operation as shall be mutually agreeable <br /> to the City and the School. <br /> 6. Each of the parties agrees to hold each other harmless from <br /> any liability incurred by the use of these facilities during <br /> the times the premises is under the supervision or control <br /> of the other party unless from an act or condition of <br /> negligence caused or occasioned by the party then in control <br /> . <br /> of the premises. <br /> 7. School and City shall cooperate to provide, in addition to <br /> an ice hockey rink, a free ice skating rink adjacent to said <br /> hockey rink. <br /> S. City will provide regular cleaning and flooding at City <br /> expense, as needed to maintain ice surface. School district <br /> will assume additional electricity costs due to lighting the <br /> ice skating rink. <br /> 9. Notwithstanding anything in this Agreement to the contrary, <br /> it is hereby recognized that the primary function and use <br /> of these facilities shall be for the purpose of conducting <br /> the regular school curriculum and related activities and the <br /> use of these facilities for recreational purposes shall be <br /> secondary. If at any time School needs the facility during <br /> a time other than school hours, every effort will be made <br /> to give reasonable advance notice to the City. <br />
