<br /> .' , l <br /> RESOLUTION NO. 1621 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKXNG FINDINGS OF FACT, APPROVING APPLICATION FOR <br /> NON-CONFORMING USE PERMIT NC-4, AND STATING REASONS FOR SUCH <br /> APPROVALS <br /> WHEREAS Tyson Trucking Company, Inc. has made application <br /> to the City to build on properties with existing non-conformities <br /> and to expand certain non-conformities, and <br /> WHEREAS such application has been duly processed by the <br /> City staff, reviewed by the planning,eormnission, and considered <br /> by the City Council at a properly called public hearing thereon <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of <br /> New Brighton, That the .Council hereby makes the following findings <br /> of fact in respect to NC-4: <br /> Findings of Fact <br /> 1. The application for nonconforming use permit NC-4 was filed <br /> with the City on August 14, 1975. <br /> 2. The application met the technical requirements for <br /> consideration by the City Council. <br /> 3. The Planning Commission considered NC-4 on August 19, 1975 <br /> and recommended approval thereof with certain conditions. <br /> 4. The City Council pursuant to published and mailed notice <br /> held a public hearing on October 14, 1975 to consider the <br /> application. All persons present including the applicant <br /> and his contractor were given an opportunity to be fully <br /> heard. <br /> 5. The written comments and analysis of the City Building and <br /> Planning Coordinator, the Planning Commission minutes and <br /> all persons in favor and opposed to the approval of the <br /> applications were considered by the City Council. <br /> BE IT FURTHER RESOLVED, That the application far NC-4 be <br /> approved for the following reasons: <br /> 1. The impact extent, and number of non-conformities has been <br /> reduced by additional landscaping in the f~ont yard, by <br /> reduction of parking in the front yard, by addition of <br /> concrete curbs, and by painting of the building. <br />
