'. . \ <br /> RESOLUTION NO. 1610 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION ORDERING ABATEMENT OF NUISANCE BY THE CITY OF NEW <br /> BRIGHTON, PROVIDING FUNDS TO ABATE SUCH NUISANCE AND PROVIDING <br /> FOR THE ASSESSMENT OF THE COSTS OF ABATEMENT <br /> WHEREAS the property at 1711 and 1727 Roxanna L~he <br /> (lots 11 and l2, Block 3, Amber oaks) has been used for the <br /> dumping of refuse and accumulations of such refuse continue to <br /> exist on said property which condition constitutes a nuisance and a <br /> possible rodent harborage endangering the public health and <br /> safety, and <br /> WHEREAS said property has also been improperly graded in SLCI1 <br /> a way as to cause a large amount of water to accumulate and remait: <br /> on such property which condition constitutes an attractive <br /> nuisance and a vio1agion of section 406:04, Subd. 6 of the New <br /> Brighton Building Code, and <br /> WHEREAS there exists on said property a storm sewer adequa1:e <br /> to receive and remove all storm water from the property in <br /> question, and <br /> WHEREAS the owner of said property was at City Council <br /> direction, duly notified of the violations in question and was <br /> ordered to cease such violations by the '22nd of September, 1975, clUe <br /> WHEREAS such conditions constitute a serious threat to the <br /> public health, safety a~d welIare <br /> NOW THEREFORE BE IT RESOLVED by the City of New Brighton: <br /> 1. The City Manager shall cause the refuse on such <br /> property to be removed from the property and <br /> properly disposed of, or cause such refuse to be <br /> buried on the property where such action is feasible <br /> and will cause no threat to public health, safety, <br /> or welfare; <br /> 2. The City Manager shall cause such property to be <br /> regraded to eliminate accumulations of storm water <br /> and properly drain all storm water from the property <br /> in question to the storm sewer existing on such <br /> property; <br /> 3. The City Manager shall report to the City Council as <br /> soon as practicable the cost to the City in cleaning <br /> up and grading such property and other work associated <br /> therewith in the abatement of said nuisance; <br /> ), <br />
