<br />..' ~, .-..-. <br /> RESOLUTION NO. 1597 <br /> STATE OF MINNESO~ <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT, GRANTING VARIANCE VN-142, <br />AND STATING REASONS FOR SUCH APPROVAL <br /> WHEREAS Crickett Inn and Griffis, Inc. have made application <br />to the city for a variance to permit a',billboard on a parcel of <br />land which has existing signs and a billboard which dOes not <br />conform to the provisions of Chapter XIV of the Zoning Code, and <br /> WHEREAS such application:ha-s been duly processed by the City <br />staff, reviewed by the Planning Commission and considered by the <br />City Council at a properly called public hearing thereon <br /> NOW THEREFORE BE IT RESOLVED by the New Brighton City Council <br />that the following findings of fact are hereby made in respect <br />to VN-142: <br />1. The application for variance VN-142 was filed with the City <br />on July 9, 1975. <br />2. The application met the technical requirements for consider- <br />ation by the City Council. <br />3. The Planning Commission considered the application on July 15, <br />1975, ,and recommended its approval upon certain conditions. <br />4. TheCi~~~ouncil, pursuant to published and mailed notices, <br />held a public hearing on August 12, 1975. All persons, present, <br />including the applicants, were given fu 11 opportunity to b'e~heard. <br />5. The written comments and analysis of the City Building and <br />Planning Coordinator, the Planning Commission minutes and all <br />statements made in favor of and opposed to the granting of the <br />variance were considered by the City Council. <br />6. The property in question has an existing billboard, and other <br />existing signs which do not conform to Chapter XIV of the Zoning <br />Code. <br />7. If all of the existing signs on this property conformed to <br />Chapter XIV of the Zoning Code, the proposed additional billboard <br />would be automatically permitted under the Code <br /> BE IT FURTHER RESOLVED, That Variance VN-142 be granted on <br />the following conditions: <br />1. The billboard now existing on the property be altered so as <br />to conform to Chapter XIV of the Zoning Code not later~than <br />December 23, 1975, and further, That proof be presented to the <br />City before a permit for the new billboard issues, that the lease <br />for the existing billboard has been amended in writing to <br />require lessee to alter such billboard so as to make the same <br />conforming with City Code by December 23, 1975. <br />I <br />
