<br />r'7t , ( <br />A .' ~ ) <br />~/ . ~ <br />'--" <br /> RESOLUTION NO 1549 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND GRANTING PERMISSION TO <br /> USE A NON-CONFORMING PROPERTY :; <br /> WHEREAS the property located at 981 5th Avenu,e Northwest <br /> in the city of New Brighton was previously used as a gasoline <br /> service station and such use was disconti.nued for more than <br /> 6 months, and <br /> WHERBAa an application has been made for permission to <br /> again use the property as a gasoline service station <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> council makes the following findings of fact: <br /> A. The following non-conformities exist on the property. <br /> 1. There are four driveways to the property - this is <br /> two in excess of the number of driveways permitted <br /> under Section l2-060(c). <br /> 2. Two driveways are less than 50 feet from the <br /> street corner which is a violation of Section <br /> l2-060(b) <br /> 3. A small portion of the building is within the <br /> thirty foot rear yard setback area required under <br /> Section 10-090(d). <br /> 4. The blacktopped areas south and east of the I <br /> building are not bordered by concrete curbs as <br /> required in Section l2-060(a) and l2-050(e). <br /> 5. There is an insufficient number of parking spaces <br /> that can be provided on the property in violation <br /> of the requirements of Section 12-050. <br /> 6. There are no landscaped areas along the street <br /> sides of the property as required by Section 12-030. <br /> B. The Planning Commission recommends approval of the <br /> request to re-use the p~operty with the conditions <br /> that: <br /> 1. The applicant repaint the building prior to <br /> opening. <br /> 2. The applicant install landscaped areas as shown <br /> on the plan dated May 13, 1975 and signed <br /> by the applicant. <br />
