<br />, . ..-.. <br />-;'" J <br /> RESOLUTION NO. 1519 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION AUTHORIZING SETTLEMENT OF ASSESSMENT APPEAL BY <br />INDEPENDENT SCHOOL DISTRICT NO. 621 FROM ASSESSMENTS LEVIED FOR <br />IMPROVEMENT NO. 69-10 <br /> WHEREAS Improvement No. 69-10 included construction of <br />water, sanitary sewer, street and curbs on 13th Street along the <br />southerly property line of the Pike Lake Elementary School, and <br /> WHEREAS the Independent School District No. 621 was assessed <br />the sum of $10,810.80 for this improvement on August 12, 1971, and <br /> WHEREAS said School District objected to the improvement, <br />objected to the assessment and has appealed the assessment validity <br />to the Ramsey County District Court and has refused to pay the <br />assessment, and <br /> WHEREAS the City Attorney has expressed doubts as to the <br />validity of the assessment in the amount levied and the said School <br />District has offered to pay the surn,of $5,405.40 within 60 days in <br />full settlement <br /> NOW THEREFORE BE IT RESOLVED, That the City Attorney is herec~ <br />authorized and directed to settle the Ramsey County District Court <br />case entitled Independent School District No. 621 vs. Village of <br />New Brighton (D.C. File #379709) for the sum of $5,405.40 to be paid <br />by said School District to the City of New Brighton within 60 days <br />and the Mayor, Manager, and Clerk-Treasurer are hereby authorized <br />and directed to do all things necessary to accomplish this settle- <br />ment. <br />Adopted by the New Brighton City Council this lIth day of <br />March, 1975. <br />ATTEST: ,V~;;nJ?t~k~.~_/ <br />~ e~J~,- c~~. <br /> Thomas F.
