<br /> . .' <br /> , .,.. . , <br /> ~ <br /> RESOLUTION NO. 1724 <br /> STATE OF MINNESOTA I <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING F!NDINGS OF FACT, declaring Lot A as a ( <br /> public highway WHEREAS the City of New Brighton has surfaced and maintained ~ <br /> a roadway and utilities in Lot A, Long Beach Subdivision to the -I <br /> City of New Brighton, and said roadway has been used by the public',. <br /> all for a period in excess of six (6) years, and <br /> WHEREAS in the maintenance of said roadway at land lying i <br /> between the surfaced portion of the road and the outer boundarieJ <br /> I <br /> of said Lot A has been including sewer and water and is a necessary <br /> part of the roadway for public street purposes in said area, and <br /> WHEREAS that maintenance, construction, repair and use of <br /> said Lot A has all been done pursuant to provisions of Minnesota <br /> Statute 160.05# <br /> IT IS HEREBY RESOLVED by the New Brighton City Council that <br /> it make the following Findings of Fact: <br /> 1. That the centerline of the Long Lake Beach Road lies in <br /> Lot A, Long Lake Beach Subdivision to the City of New Brighton <br /> commencing at the intersection of the westerly extension of the <br /> south line of Lot 9~ Long Lake Beach Subdivision in the City of <br /> New Brighton and lies within Lot A of said Subdivision and lies <br /> 15 feet northwesterly of Lots 9, 8, 7, 6, 5 and northerly of Lots <br /> 4, 3, 2, and 1 extending to the east line projected of said Lot 1 <br /> of Long Lake Beach Subdivision. <br /> 2. That the aforesaid centerline describes the center of a <br /> public highway which has been used and kept in repair and worked <br /> continuously as a public highway for a period in excess of six yealcs. <br /> 3. The public use of land consists of all of Lot A but does <br /> not encroach upon other property boardering upon said Lot A. <br /> BE IT FURTHER RESOLVED that the Council of the City of New <br /> Brighton by the powers invested in it through the Constitution <br /> and Statutes of the State of Minnesota has hereby declared the <br /> above describeq. road consisting of the property lying on either <br /> side of the centerline above described as b~ing- all of the follow- <br /> ing described property to wit: <br /> Lot A Long Lake Beach Subdivision ~o the~ity of New <br /> Brighton according to the plat thereof on file and of <br /> record in the office of the Register of Deeds in and for <br /> Ramsey County, State of Minnesota, to be predicated to <br /> the public use. <br /> Adopted this 8th day of June 1976. <br /> , <br />
