. .' , .,.. . , ~ RESOLUTION NO. 1724 STATE OF MINNESOTA I COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING F!NDINGS OF FACT, declaring Lot A as a ( public highway WHEREAS the City of New Brighton has surfaced and maintained ~ a roadway and utilities in Lot A, Long Beach Subdivision to the -I City of New Brighton, and said roadway has been used by the public',. all for a period in excess of six (6) years, and WHEREAS in the maintenance of said roadway at land lying i between the surfaced portion of the road and the outer boundarieJ I of said Lot A has been including sewer and water and is a necessary part of the roadway for public street purposes in said area, and WHEREAS that maintenance, construction, repair and use of said Lot A has all been done pursuant to provisions of Minnesota Statute 160.05# IT IS HEREBY RESOLVED by the New Brighton City Council that it make the following Findings of Fact: 1. That the centerline of the Long Lake Beach Road lies in Lot A, Long Lake Beach Subdivision to the City of New Brighton commencing at the intersection of the westerly extension of the south line of Lot 9~ Long Lake Beach Subdivision in the City of New Brighton and lies within Lot A of said Subdivision and lies 15 feet northwesterly of Lots 9, 8, 7, 6, 5 and northerly of Lots 4, 3, 2, and 1 extending to the east line projected of said Lot 1 of Long Lake Beach Subdivision. 2. That the aforesaid centerline describes the center of a public highway which has been used and kept in repair and worked continuously as a public highway for a period in excess of six yealcs. 3. The public use of land consists of all of Lot A but does not encroach upon other property boardering upon said Lot A. BE IT FURTHER RESOLVED that the Council of the City of New Brighton by the powers invested in it through the Constitution and Statutes of the State of Minnesota has hereby declared the above describeq. road consisting of the property lying on either side of the centerline above described as b~ing- all of the follow- ing described property to wit: Lot A Long Lake Beach Subdivision ~o the~ity of New Brighton according to the plat thereof on file and of record in the office of the Register of Deeds in and for Ramsey County, State of Minnesota, to be predicated to the public use.
