That the hearings related to PRD No. 21, provided clear <br /> and uncontroverted evidence that the level of the ponds <br /> in Outlot A of PRD No. 18, has been rising since the <br /> approval of PRD NO. 18 thereby blocking or making <br /> circuitous access to said outlot, requiring the grades <br /> of lots 8 through 12, Block 1, Silver Oak Estates, <br /> No. 3 to be elevated above that planned in PRD No.18 <br /> and requiring changes in site preparation~ <br /> 9. That the city of New Brighton was advised prior to and <br /> du:,:-ing the process of granting approval to PRD NO. 18, by <br /> the .applicant that the ponds could easily handle and <br /> absorb the storm water runoff directed and diverted to <br /> such pondsi <br /> 10. That ,the ponds of Outlot A are ptotected as part of the <br /> Zoning on PRD No. 18i <br /> 11. That the hearings related to PRD NO. 18 provided <br /> evidence that Lots 8 through 12, Block 1, Silver Oak <br /> Estates, NO. 3 when developed would create problems <br /> requiring screeningi <br /> 12. That that poriton of PRD No. 18 known as Lots 8 through <br /> 12, Block 1, Silver Oak Estates No. 3, can be revised <br /> in such a fashion as to eliminate access problems, <br /> reduce the impact of grade and site preparation and <br /> provide for screening while maintaining the amenities <br /> of Outlot A protected by the zoning restrictions <br /> of PRD No. 18 by making a lesser density of lots at <br /> sizes equal to or greater than standard single family <br /> lot area requirements. <br /> BE IT FURTHER RESOLveD, That it is hereby declared and <br /> directed that noperm~ts shall be issued for any construction or <br /> alterations on ;t..otE; 8' through 12 inclusive, Block l, Silver Oak <br /> Estates No. 3, without provision to and approval by the City <br /> council of a rev~sion to PRD No. 18 as to Lots 8 through l2 <br /> inclusive, Block 1 Silver Oak Est~te Nq.. 3 <br /> BE IT FURTHER RESOLVED, That such action is based upon the <br /> above Findings of Fact <br /> BE IT FURTHER RESOLVED, That any revision to PRD No. 18 <br /> shall provide for lot sizes meeting or exceeding the lot areas of <br /> single family residential lots in the city of New Brighton shall <br /> provide for pedestrian and vehicle access to Outlot A in such a <br /> manner as to protect the amenities of Outlot A and shall provide <br /> for effective screening along the driveway access. <br /> Adopted this 28th day of December 1976 <br /> ATTEST: <br /> - <br /> C.
