<br />~. ,.- ~ <br />i+ <br /> RESOLUTION NO. 1815 A <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR VN-166 <br /> WHEREAS an application for VN-166 has been made in order <br />to permit the subdivision of lots with less than minimum lot <br />width, and <br /> WHEREAS the procedural history of the application is as <br />follows: <br /> l. The application for VN-166 was. filed with the City <br /> on November 4, 1976~ <br /> 2. The City Council pursuant to published and mailed <br /> notice held a hearing on December 28, 1976 at which <br /> time VN-166 was considered; <br /> 3. The applicant and other persons present at the <br /> hearing were given an opportunity to be heard~ <br /> 4. The written comments and analYE;is of the Building <br /> and Planning Department and the Planning Commission <br /> minutes and recommendations and all persons' statements <br /> made at the public hearing inclUding the statements <br /> of the applicant were considered by the Council. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />the application for VN-166: <br /> 1. That the parcel is of such size that only three lots <br /> could create meeting the minimum lot width of 75'~ <br /> 2. That::faur lots with a lot width of 7416" could be <br /> created each lot being almost double the City's <br /> minimum lot area requirement~ <br /> 3. That a 74'6" lot width is not significantly different <br /> from a 751 lot width; <br /> 4. That hardship would be created byn,ot allowing four <br /> lots based :upon the above unique circumstances~ <br /> 5. That no special privilege would accrue to the property <br /> in permitting four lots because of the oversized area <br /> of the lots and small deviation in lot width. <br /> BE IT FURTHER RESOLVED, That based upon the above Findings <br />of Fact the application for VN-167 be and is hereby approved. <br />Adopted this 28th day of December, 1976 <br />ATTEST: <br />- ~ ~--_...., ,Qa ' <br />V~, ~.{~/ <br />Vernon c.
