<br />. ,I <br />4 and payable, the member shall nevertheless make such payment in <br /> order to preserve its status as a member in good standing, but <br /> such payment may be made under protest and without prejudice to its <br /> right to dispute the amount of the charge and to pursue any legal <br /> remedies available. <br /> Section 5. The charges of the Consortium shall be divided into <br /> three classes: <br /> a) Class I: These charges shall be made to cover the <br /> general administrative and operational expenses not <br /> falling within Class II and III. Class .1 charges shall <br /> be made as a membership due. These charges shall not <br /> be retroactively applied to new members. <br /> b) Class II: These charges shall be made to cover the <br /> costs of design and development of computer programs <br /> and systems and other capital costs. Each member <br /> shall pay such portion of the Class II charges as <br /> shall be established by the Board, provided that the <br /> Board shall attempt to pro rate such charges among <br /> the members in as equitable a manner as possible, giving <br /> consideration, among other things, to anticipated use of <br /> the programs, systems and facilities. New members shall <br /> pay a pro rated share of the accumulated charges which <br /> have been charged to or incurred by all members. Such <br /> charges when paid by new members shall be apportioned <br /> among the existing members in cash or credit when possible, <br /> as determined by the Board. <br /> c) Class III: These charges shall be made to cover the <br /> costs of system operation and maintenance in servicing <br /> members on an "as requested II basis. The amount of such <br /> charges shall be determined on the basis of the actual <br /> workload utilized. <br /> Section 6. Nothing contained in the foregoing Section 5 shall <br /> prevent the Board from charging nonmembers for services rendered <br /> by the Consortium on such basis as the Board shall deem appropriate. <br /> Section 7. Expenditures of the Consortium shall be in accordance <br /> with procedures established by law. <br />VII. EMPLOYEES " <br /> Section 1. All employees of the Consortium shall be assigned to <br /> a member community. The member community shall be responsible <br /> for rendering all employment benefits and direct supervision of <br /> employees in accordance with policies established by the Board. <br /> Section 2. Any member, assigned an employee, shall be reimbursed <br /> by the Consortium for all costs incurred as a result of that <br /> assignment, including personal services and administrative over- <br /> head. <br />
