<br />J '.' .(' <br /> , <br />, <br /> RESOLUTION NO. 1805 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION RESCINDING RESOLUTION 1706 ENTITLED -RESOLUTION MAKING <br />FINDINGS OF FACT, DECLARING MORATORIUM ON BUILDING PERMITS IN LOTS <br />8-12, BLOCK 1, SILVER OAKS ESTATES NO.3, AND STATING REASONS <br />THEREFORE" <br />WHEREAS at a public hearing regarding a proposed P.R.D. <br />amendment involving Lots 8-12, Block, 1, Silver Oaks Estates No. 3 <br />held April 12, 1976, evidence was .submitted indicating that the <br />water level of the ponds in Outlot A, owned by the homeowners Asso~ <br />ciation of the P.R.D. had reached an elevation which could create <br />a danger to the health, safety and welfare of residents of exist- <br />ing homes within the P.R.D., and a building moritorium was imposed <br />and the problem was referred to the Director of Public Works for <br />study and report, and <br />WHEREAS at a public hearing held December 2, 1976, based on <br />the Director of Public Works report all effected property owners <br />were notified of such public hearing and all persons desiring to <br />be heard were given an opportunity to be heard theron, and all <br />objections were heard and passed upon, and no further action was <br />taken pursuant to such public hearing. <br />NOW THEREFORE HE IT RESOLVED by the Council of the City of <br />New Brighton that Resolution 1706 adopted April 27, 1976 imposing <br />a building permit moritoruim for Lots 8-12, Block 1, Silver Oaks <br />Estates No. 3 be and is hereby rescinded. <br />Adopted this 14th day of December 1976 <br />ATTEST: <br />~. ~1)~AA~/ CilItfmM ;:~ <br /> Thomas F.
