<br /> ! <br />'" , . . , <br /> -r <br />....,. <br />~ <br />.. - AGREEMENT <br />, <br /> This agreement entered into this 25th day of January, <br /> 1977, by and between The Menge1koch Company, hereinafter <br /> "COMPANY" and the City of New Brighton, hereinafter "CITY" , <br /> WIT N E SSE T H <br /> WHEREAS, COMPANY has been granted an Offensive Trades <br /> License for the year 1977 by CITY in Resolution No~ 1803A <br /> on condition, among other actions, of the execution of an <br /> agreement in regard to testing of emissions into the ambient <br /> air from COMPANY's facilities.. <br /> WHEREAS, COMPANY is desirous of continuing its operation <br /> as a rendering plant in the City, of New Brighton during the <br /> year 1977. <br /> NOW THEREFORE IT IS AGREED BY ':I'HE PARTIES HERETO AS <br /> FOLLOWS: <br /> 1- That emissions from the exhaust stacks of the <br /> following equipment shall be tested once in each <br /> six month period: <br /> a. Barrel Washing Steam Exhaust (if such emission <br /> ~b. is not inl1u=~ ~. the emission from scrubbers <br /> numbered ~ . below) <br /> Multi-Stage Scrubber 200-71-0-1 <br /> c. Packed Tower Scrubber 200-75-0-2 <br /> 2. That all costs associated with the tests and reports <br /> shall be borne by and paid for by COMPANY. That <br /> COMPANY shall allow the firm selected to perform <br /> the tests between the hours of 3:00 P.M. and 12: 00 <br /> midnight, Monday thru Friday with no more than <br /> one (1) hour prior notice of intent to perform said <br /> tests and shall not restrict the testing company <br /> from access to the property or facilities. <br /> 3. That the City shall select the firm contracted to <br /> perform the test after first consulting with The <br /> Menge1ko4h Co. and that the date and time for such <br /> stack tests shall be at the discretion of the City <br /> of New Brighton. The first such test of each stack <br /> emission shall not be performed until completion <br /> of the proposed plant expansion authorized by the <br /> New Brighton City Council on July 13, 1976 and <br /> by Building Permit No. 5648, issued 10-29-76, and <br /> until completion of improvements to the barrel <br /> washing steam exhaust listed in 2.a. above. In no <br /> case, however, shall said first tests be performed <br /> at a date later than March 1, 1977, provided that if <br /> the proposed construction is not completed by said <br /> date, because of circumstance beyond the control of <br /> COMPANY , then and in that event, the tests shall be <br /> performed within fifteen (15) days of completion of <br /> said construction. <br /> 4. Stack emission tests shall be conducted in complete <br /> conformance to American Society for Testing Material <br />
