" <br /> <br /> <br /> <br />.... <br /> <br />RESOLUTION NO.~79~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATIONS FOR <br />VN- J.63 <br /> <br /> <br />WHEREAS an application for variance entitled VN-163 has been <br />made to the City and said application has been processed and <br />reviewed by the Planning Commission at its meeting on September 21, <br />1976, and heard and considered by the Council at a public hearing <br />on October 12, 1976. <br /> <br />NOW THEREFORE B.E IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of. Fact in respect to VN-163: <br /> <br />Finding of Fact <br /> <br />1. That an application for VN-163 was filed with the City on <br />September 14, 1976, and was heard and reviewed by the Planning <br />Commission at its meeting of September 21, 1976i <br /> <br />2. That the City Council, pursuant to published and mailed notices, <br />held a public hearing on October 12, 1976, to consider the <br />application. The Applicant and other persons present at the <br />hearing were given an opportunity to be heard~ <br /> <br />3. The written comments and analysis of the City P1ann~r, the <br />Planning Commission minutes and recommendations and all <br />persons' statements made at the public hearing were considered <br />including the statements of the applicant and members of the <br />Counci1i <br /> <br />4. That at the regular meeting of November 9, 1976, the applicant <br />provided additional information which the Council considered. <br /> <br />BE IT FURTHER RESOLVED, That the application for VN-163 be <br />hereby approved for a 3.3 foot sideyard setback variance for the <br />following reasons: <br /> <br />1. That undue hardship existE; because a two-car garage would be <br />precluded because of a 3.3 foot intrusion into the setback <br />areai ! <br />! <br /> <br />2. That unique circumstances applying to the property exists <br />because: <br />a. The house was to a small degree misplaced on the site. <br />b. Placement of a garage in the rear of the property would <br />create drainage and grade prob1emsi <br />c. The proposed garage being recessed modifies the impact of <br />the variance on site distance at the intersection. <br />d. The variance allows parking and garage access from 17th <br />Avenue NW rather than 7th Street'.' <br />e. A garage access from 7th Street could create a drainage <br />problem. <br /> <br /> <br /> <br /> <br /> <br />i <br />
