RESOLUTION NO., I <br />-:,. <br />''- <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGmaN <br /> RESOLUTION MAKING FINDINGS OF FACT,DEN'YING APPLICATION FOR <br /> VARIANCE NO. 155 AND STATING REASONS FOR SUCH DENIAL <br /> WHEREAS an application for Variance No. 155 has been made <br /> to the City and such application has been processed, reviewed by <br /> the Planning Commission and considered by the Council at a <br /> public hearing <br /> NOW THEREFORE BE IT RESOLVED That the New Brighton City <br /> Council makes the following findings of fact in respect to <br /> VN-155 <br /> t> <br /> FINDINGS OF FACT <br /> 1. That an application for VN-155 was filed with the City on ~ <br /> April 13, 1976; , <br /> 2. That the application met the technical requirements for <br /> consideration by the City; <br /> 3. That the Planning Commission considered the application at <br /> its regular meeting of April 20, 1976 and recommended <br /> approval of the application; I <br /> I <br /> , 4. That the City Council pursuant to published and mailed notice;' <br /> held a public hearing on May 25, 1976. That the hearing <br /> was continued to June 8, 1976, June 22, 1976, July 27, 1976, <br /> and August 24, 1976 in order to afford the applicant an <br /> opportunity to resolve the land problem without need for <br /> a variance. <br /> 5. The written comments and analysis of the City Planner, the i <br /> Planning Commission minutes and .+ecommendations and all : <br /> persons I statements made at the public hearings were <br /> considered including the statements of the applicant; <br /> , <br /> 6. That at the Council meeting of August 24, 1976 a letter was <br /> received from the applicant requesting withdrawal of the <br /> application based on the land problem being resolved by 1 <br /> way of easement; I <br /> 7. That based on said letter noted in No. 6 above no variance <br /> is required. <br /> BE IT FURTHER RESOLVED, That the application for VN-155 be <br /> hereby denied because of the facts stated above. <br /> ! <br />
