<br /> ~ J.;- <br />/II "'\: <br /> RESOLUTION NO. 1758 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR NON-CONFORMING USE PERMIT NO. 12 <br /> WHEREAS an application for Non-Conforming Use Permit No. 12 <br /> has been made to the City and said application. has been <br /> processed, reviewed by the Planning Commission and considered by <br /> the Council at a public hearing : <br /> NOW THE REF ROE BEi~T RESOLVED That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> NC-12: <br /> Findings of Fact: <br /> 1. That an,.application for NC-12 was filed with the City on <br /> August 11, 1976; <br /> 2. That the application met the technical requirements for <br /> review by the City; <br /> 3. That the Planning Commission considered the application at its <br /> regular meeting held on August 17, 1976 and recommended <br /> approva 1 ; <br /> 4. That the City council, pursuant to published and mailed <br /> notices held a public hearing on August 24, 1976 at which <br /> time the written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendations and <br /> all persons' statements made at the public hearing were <br /> considered including the statements. of the applicant; <br /> 5. That the total number of non-conformities are being <br /> reduced and the impact of non-conformities is being reduced <br /> to the greatest practical extent by way of installing <br /> concrete curbs along the northern boundary of the parking <br /> lot; <br /> 6. That the non-conformity created by lack of all required <br /> parking stalls in mitigated by the large available <br /> parking area across the street <br /> BE IT FURTHER RESOLVED That NC-12 be hereby approved <br /> based upon the above~findings, of fact. <br /> ";,'r <br /> BE IT FURTHER RESOLVED That the administration be directed <br /> to work with the proB~rtyowner and Brighton Square Homes <br /> Association Architectual Control Committee uohe1p resolve <br /> - lighting problems on the property <br /> Adopted this 24th day of August, 1976 <br /> ATTEST: <br /> - <br /> ~~~j),~ <br /> Vernon C.
