, T " ~ " . '... 4 . . RESOLUTION NO. 1757 i STATE OF MINNESOTA COUNTY OF RJ;MSEY CITY OF NEW BRIGHTON RESOLUTION VACATING THE SEWER EASEMENT THROUGH PARCEL No. 63-02900-110-76. WHEREAS the City city Council initiated vacation proceedings to consider the vacation of the sewer easement through Parcel No. 63-02900-110-76, and WHEREAS the City Council pursuant to M.S.A. 412-851 ordered a public hearing to consider such easement vacation for August 24, 1976, and WHEREAS pursuant thereto notice of a public hearing thereon was duly published in the official newspaper and such notice was duly posted according to law, and WHEREAS said public hearing was held August 24, 1976 and all persons desiring to be heard were given an opportunity to be heard thereon and it appearing to be in the best interest of the City and the surrounding property owners to approve such easement vacation. NOW THEREFORE BE IT RESOLVED by the Council of the City of New Brighton that the following easement is hereby vacated. "THAT PART OF THE FOLLOWING DESCRIBED EASEMENT: A strip of land 10 feet wide, the West line of which is described as follows: Beginning at a point on the east line of the West 250 feet of the NE 1/4 of Section 29, 180 feet north of the South line thereof: thence southwesterly to a point in the East line of the West 150 feet of the SE 1/4 of Section 29, 1,250 feet north of the South line thereof and there terminating: WHICH LIES WITHIN THE FOLLOWING DESCRIBED PROPERTY: That part of the north 225 feet of the south 785 feet of the NW 1/4 of the SE 1/4 of Section 29, T30, R23, lying west of the land conveyed to the Minneapolis, St. Paul and Sault St. Marie Railway'Company in 530 Deeds 135 except the north 100 feet ef the South 660 feet of the west 140 feet of the NW 1/4 of Section' 29, T30,R23. II NOW THEREFORE ':BE IT FURTHF;R RESOLVED, that the Mayor and Manager are hereby authorized and directed to execute the , ! !; , . ~
