STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON i RESOLUTION MAKING FINDINGS OF FACT,DENYING APPLICATION FOR VACATION OF PONDING EASEMENT, AND STATING REASONS FOR SUCH DENIAL ! ~ ! WHEREAS upon request of the owner of Lot 5, Block 1, Carpe Diem, the City Council initiated proceedings for the vacation of all or part of the ponding easement on said property ~ NOW THEREFORE BE IT RESOLVED That the New Brighton City Council make the following Findings of Fact regarding the ponding easement vacation: FINDING OF FAC!' 1. At the regular meeting of July 27, 1976 the Council received a letter from the owner of Lot 5, Block 1, Carpe Diem requesting vacation of all or a part of a ponding easement so thata swimming pool could be constructed; 2. At the regular meeting of July 27, 1976 a report was received from the Building and Planning Coordinator regarding the easement; 3. That at the regular meeting of July 27,1976 the Council called a public hearing and requested the property owner to present a revised description for the ponding easement; 4. That the property owner verbally informed the administration prior to the hearing that the owner did not wish to pursue the easement vacation further at this time~ 5. That the City Council pursuant to published and posted notice held a public hearing on August 24, 1976 and that no one appeared or spoke regarding said vacation; 6. That the revised description for the ponding easement was not presented. BE IT FURTHER RESOLVED That the request for vacation of . all or a part of the ponding easement on Lot 5, Block 1, Carpe Diem be denied based upon the above Findings of Fact. , .
