<br />fr r <br /> ~ .. <br /> RESOLUTION NO. 1746 <br />I <br />I <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE <br /> PERMIT SP-71 AND VARIANCE VN-158 UNDER CERTAIN CONDITIONS <br /> WHEREAS an application for Special Use Permit No. 71 and <br /> Variance No. 158 has been made to the City and said applications <br /> have been processed, reviewed by the Planning Commission and <br /> considered by the Council at a public hearing <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> SP-71 and VN-158: <br /> Findings of Fact <br /> 1. That an application for SP-71 was filed with the City on <br /> June 9, 1976; <br /> 2. That an application for VN-158 was filed with the City on <br /> July 14, 1976; <br /> 3. That the applications met the technical requirements for <br /> consideration by the City; <br /> 4. That the Planning Commission considered both applications <br /> at its regular meeting of July 20, 1976, and recommended <br /> approval of the applications under certain conditions; <br /> 5. That the City Council, pursuant to published and mailed <br /> notices held a public hearing on August 10, 1976 to consider <br /> the applications. The applicant and others present at the <br /> hearing were given an opportunity to be heard; <br /> 6. The written co~ents and analysis of the City Planner, the <br /> Planning CommisSion min:utes and. recomm:endations and all <br /> persons' statements made at the public hearing were <br /> considered, including the statements of the applicant. <br /> BE IT FURTHER RESOLVED That the application for Special Use <br /> Permit No. 71 be approved for the following reasons: <br /> 1. The proposed use is similar to other uses permitted in I-1 <br /> districts such as truck yards, truck terminals, warehouses, <br /> and packing and crating establishments; <br /> 2. The traffic generated by the use will not pose a problem as <br /> the use is located on a major roadway which is an established <br /> truck route. <br /> BE IT FURTHER RESOLVED, That ' he application for Variance <br /> No. 158 be approved for the following reasons . <br /> . <br /> 1. There exists special circumstances because the main structure <br /> is set back 180 feet from Old Highway 8; <br /> 2. Requiring 180 feet of front yard landscaping would prohibit <br /> the use of a substantial portion of the property creating an <br /> undue hardship. <br />
