RESOLUTION NO. 1746 I I STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SPECIAL USE PERMIT SP-71 AND VARIANCE VN-158 UNDER CERTAIN CONDITIONS WHEREAS an application for Special Use Permit No. 71 and Variance No. 158 has been made to the City and said applications have been processed, reviewed by the Planning Commission and considered by the Council at a public hearing NOW THEREFORE BE IT RESOLVED, That the New Brighton City Council makes the following Findings of Fact in respect to SP-71 and VN-158: Findings of Fact 1. That an application for SP-71 was filed with the City on June 9, 1976; 2. That an application for VN-158 was filed with the City on July 14, 1976; 3. That the applications met the technical requirements for consideration by the City; 4. That the Planning Commission considered both applications at its regular meeting of July 20, 1976, and recommended approval of the applications under certain conditions; 5. That the City Council, pursuant to published and mailed notices held a public hearing on August 10, 1976 to consider the applications. The applicant and others present at the hearing were given an opportunity to be heard; 6. The written co~ents and analysis of the City Planner, the Planning CommisSion min:utes and. recomm:endations and all persons' statements made at the public hearing were considered, including the statements of the applicant. BE IT FURTHER RESOLVED That the application for Special Use Permit No. 71 be approved for the following reasons: 1. The proposed use is similar to other uses permitted in I-1 districts such as truck yards, truck terminals, warehouses, and packing and crating establishments; 2. The traffic generated by the use will not pose a problem as the use is located on a major roadway which is an established truck route. BE IT FURTHER RESOLVED, That ' he application for Variance No. 158 be approved for the following reasons . . 1. There exists special circumstances because the main structure is set back 180 feet from Old Highway 8; 2. Requiring 180 feet of front yard landscaping would prohibit the use of a substantial portion of the property creating an undue hardship.
