<br />......-.-'\..~ <br />-, <br />" <br /> " ,. <br /> RESOLtJrION NO. 1717 <br /> STATE OF MINNEsarA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGH'I'OO <br /> RESOWl'ION MAKING FINDINGS OF FAC!', DENYING APPLICATION FOR PRELIMINARY <br /> APPRfNAL OF PRO #22 AND STATING REASONS FOR SUCH DENIAL <br /> WHEREAS an application for preliminary approval of PRO #22 has <br /> been made to the City and said application has been processed, reviewed <br /> by the Planning Coomission and considered at a public hearing <br /> NOW '1'HEREFORE BE IT RESOLVED, That the New Brighton City CmIDcil <br /> m:lkes the follOWing Findings of Fact in respect to PRO #22: <br /> FINDINGS OF FACt' <br /> 1. An application for preliminary approval for PRO #22 was <br /> filed with the City on March 26, 1976; <br /> 2. The application net the technical requirerrents for consideration <br /> by the City, Council; " <br /> 3. The Pl.aoning Conmission, considered the application at its <br /> regular public rreetings held on April 20, 1976, and recomrended <br /> denial of the application; <br /> 4. The City Council, pursuant to published and ma.iled notices, <br /> held a, public hearing on May 11, 1976, to consider the <br /> application. All persons present, including the applicant, <br /> were given an opportunity to be heard. <br /> 5. The written ccmrents and analysis of the City Planner, the <br /> Planning Conmission minutes and recorrmendations and all <br /> persons I staterrents ma.de at the publ.ic hearing were considered <br /> including the staterrents of the applicant. <br /> BE IT FURI'HER RESOLVED, That the application for preliminary <br /> approval of PRO #22 be and is hereby denied for the following reasons: <br /> l. The plan includes a number of lots sma.ller in front footage <br /> and total. lot size than the size required by the zoning code <br /> and smaller than the typical. residential lots in the neighbor- <br /> hOOd. The petitioner failed to show any offsetting or balancing <br /> design consideration in the plan to justify the small lots. The <br /> only purpose appeared to be increasing the density of population <br /> to rrore than would be available under conventional platting. <br /> 2. The small lot size is inappropriate to the area and would <br /> change the character of the neighborhood. The ordinance practi.ces <br /> and pOlicies of the City discourage creation and use of substandard lots. <br /> 3. The open space provided in the plan is not intergrated into <br /> the deve10prrent and is not readily accessible to residents <br /> of west and East parcels. The petitioner uses the PRO to <br /> rraximize the number of units in a particular area and <br /> designating as open space that property which has soil problems <br /> and, therefore, not readily usable for park or recreational <br /> purposes. <br />
