The water in said ponds continues to rise as <br /> time passes with no indication that the water level in <br /> such ponds will do anything but continue to rise. <br /> d. To permit the construction of more homes adjacent to <br /> such ponds until a solution to the rising water levels <br /> in said ponds would or could create a danger to the <br /> health, safety and welfare of residents of such homes. <br /> BE IT FURTHER RESOLVED, That it is hereby declared and <br /> directed that no building permits shall issue for any construction <br /> I on Lots 8 through 12, inclusive Block 1, Silver Oaks Estates No. 3 <br /> without special permission of the New Brighton City Council <br /> until proper action has been taken to assure that the water <br /> levels in the ponds hereinbefore described will cause no present <br /> or future damage to adjacent or nearby lands or residences. <br /> BE IT FURTHER RESOLVED, That the reasons for the foregoing <br /> action is as follows: <br /> 1. The ponds in the common area owned by the Silver Oaks <br /> Homeowners Association are adjacent to improved and unimproved <br /> residential lots and the water therein has been rising over the <br /> past few years even though it was previously estimated and predic":ed <br /> that such ponds could adequately handle the natural and diverted <br /> storm water runoff into such ponds. <br /> 2. The continued rise in the water level of such ponds, <br /> if continued and unabated could cause dangers to the health, <br /> safety and welfare of the citizens living in the residences <br /> surrounding such ponds. <br /> 3. That the aforesaid rising waters have already interfered <br /> with the convenient and safe use of recreational facilities <br /> within the area owned by the Homeowners Association by residents <br /> entitled to such use. <br /> 4. To permit the construction of additional residences <br /> adjacent to 'SUCh ponds wouldincreape the runoff into such ponds <br /> and expose more persons and property to the actual or potential <br /> damage or danger created by the rising levels of water in such <br /> ponds all to the impairment of the health, safety, welfare, <br /> order and convenience of such actual or potential residents <br /> Adopted this 27th day of April 1976. <br /> ATTEST: /' <br /> ~.e{),Q~ Thomas F.
