Claims by the city <br /> 1) Investigate and evaluate all cla~s by City against <br /> others and recommend appropriate course of action. <br /> 2) Attempt collection of all proper claims including <br /> litigation where necessary. <br /> e. Intergovernment Relations and Disputes <br /> l) Involvement in contractural dealings with Federal, <br /> State, County, Municipal and Special Districts by <br /> city of New Brighton, including joint powers act <br /> public improvements <br /> 2) Handling of disputes between City and other government <br /> units, including litigation. <br /> f. Labor Relations <br /> 1) Represent City in all disciplinary proceedings <br /> before Police Civil Service Commission <br /> 2) Represent City in proceedings .nder Veterans <br /> preference Act <br /> g. Generally provide to City all legal services required <br /> and requested by City. <br /> 2. In addit.ion to the Retainer and Hourly Charges, City shall <br /> pay Attorney all out of pocket costs reasonably and <br /> necessarily incurred by Attorney on behalf of City exclusive <br /> of local transportation, routine office expense. <br /> Examples of such chargeable costs are as follows: <br /> a. Filing fees <br /> b. Deposition costs <br /> c. Expert witness fees <br /> d. Appraisal fees <br /> e. spec-ial printing <br /> f. OUt of Metropolitan area travel <br /> g. Long distance telephone <br /> h. Court costs. <br /> c. Bill~s - Pavm$nt <br /> 1. Attorney shall submit all billings to City for hourly clllarges <br /> and costs on a monthly basis. There shall be a separate <br /> detailed bill for eilloh separate matter except matters thillt <br /> are handled in a group such as easement acquisition. All <br /> billings shall be verified under oath and shall detail the <br /> services perfo~ed, and the t~e spent and the nature of <br /> the costs incarred. Monthly billings shall be submitted <br /> by the 5th business day of the month followinq the month in <br /> which the services were performed. <br /> 2. City shall pay the retainer fee for the preceding month, and <br /> all billinqs for hourly charges and costs on the day following <br /> the first regular Council meeting in the monthsuoh billings <br /> are received. <br />
