<br /> i I <br /> , /. f ~ <br /> '" <br /> ~. <br /> 'I' , <br /> RESOLUTION NO. 1681 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT, DENYING REZONING PETITION <br /> R-88, AND STATING REASONS FOR SUCH DENIAL. <br /> BE IT RESOLVED by the New Brighton City Council, that in respect <br /> to rezoning application R-88, it makes the following findings of fact: <br /> FINDINGS OF FACT <br /> 1. On October 14, 1975 a petition was received requesting that <br /> the following described property be rezoned fron General Business B-3 <br /> to a residential zone, either Single Family Residence, R-l, Two Family <br /> Residence, R-2 or Multiple Family Residence, R-3B: <br /> .' That part of the NW~ of the NE~ of Sec 31, T 30 R 23, Ramsey <br /> ~ County, Minnesota described as follows, to-wit: Beginning <br /> " ~ at the NW corner of said NW~ of the NE~; thence on an assumed <br /> q bearing of N 89 degrees 18 minutes 38 seconds E along the N <br /> I,; <br /> line of said NW~ of the ~, a distance of 672.6 feet; thence <br /> S 0 degrees 41 minutes 22 seconds E, a distance of 235 feet; thence <br /> on a tangential curve to the left, the radius being 282.98 feet, <br /> a distance of 54.95 feet; thence S 42 degrees 10 minutes 38 <br /> seconds W, a distance of 392.07 feet; thence S 89 degrees <br /> 18 minutes 38 seconds W, a distance of 137.07 feet; thence <br /> S 53 degrees 04 minutes 45 seconds W, a distance of 188.95 <br /> feet to its intersection with a curve concave to the S, the radius <br /> of said curve being 202.46 feet, Delta Angle being 17 degrees <br /> 49 minutes 50 seconds; thence NW'ly along said curve a distance <br /> of 63.01 feet, the chord bearing of said curve being S 81 <br /> degrees 05 minutes 05 seconds E; thence on a bearing of W tangent <br /> to the last described curve to a point on the W line of said <br /> NW~ of the ~, said point being 677.39 feet S of the NW corner <br /> thereof; thence N along the W line of said NW~ of the ~ to <br /> the point of beginning, subject to the N 33 feet and the W 43 <br /> feet thereo~ for street purposes, excepting therefrom the S <br /> 200 feet of the N 233 feet of the E 200 feet of the W 233 feet <br /> thereof. (S.E. Quadrant of Silver Lake Road and County Road E) <br /> 2. That such petition was accompanied with the proper application <br /> fee and abstract showing owners of all properties within 350 feet of <br /> the subject property <br /> 3. That such petition was found to contain the signatures of <br /> 50%, or more by number, of the properties within 350 feet of the property <br /> to be zoned. <br /> 4. That such petition was duly referred to the Planning Commission <br /> on October 14, 1975. <br /> 5. That the Planning Commission considered the petition at its <br /> regular meeting on December 11, 1975, and adopted a resolution which <br /> recommended that the land be rezoned from General Business, B-3 to either <br /> Single Family Residence, R-1 or Limited Business, B-1. <br /> 6. That thereafter, on December 23, 1976 the City Council <br /> ordered a public hearing to be held on the petition on January 13, 1976, <br /> at 8:45 P.M. <br /> ! <br />
