" t" \ <br /> RESOLUTION NO. 1962 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINpINGS OF FACT AND APPROVING APPLICATION <br /> FOR NON-CONFORMING USE PERMIT NC-24 <br /> WHEREAS, an application for a non-conforming use permit <br /> entitled NC-24 has been made by Harold T. Haines to permit <br /> the construction of an addition to a building on property <br /> having Type IV non-conformities, located at 50 S.W. Cleveland <br /> Avenue, and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> 1. That an application entitled NC-24 was filed <br /> with the City on September 14, 1977 and was <br /> heard and reviewed by the Planning Commission <br /> at its meetings of September 20, 1977 and <br /> September 28, 1977; <br /> 2. That the City Council, pursuant to published <br /> and mailed notices, held a public hearing on <br /> October 25, 1977 and continued the hearing to <br /> November 9, 1977 to consider the application. <br /> All persons present at the hearing were given <br /> an opportunity to be heard. <br /> 3. The written comments and analysis of the City <br /> Planner, the Planning Commission minutes and <br /> all person1s statements made at the public <br /> hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton, that the Council hereby makes the following <br /> findings of fact in respect to NC-24~ <br /> l. A hardship would be present if the yard were <br /> required to meet the 15 foot setback because <br /> such action would redefine the front yard of <br /> the property; <br /> 2. The unique placement of the buildings on the <br /> lot is a unique circumstance; <br /> 3. Both conditions 1 and 2 are conditions applying <br /> to the property. <br /> BE IT FURTHER RESOLVED, that the application for NC-24 <br /> is hereby approved subject to the following conditions: <br /> 1. That concrete curbing be extended along the <br /> driveway to a point even with a northerly <br /> projection of the front wall line of the <br /> building; <br />
