AN OFFENSIVE TRADES <br /> LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION <br /> WHE~S The City of New Brighton is responsible for the <br /> general safety, health, welfare and well-being of its residents <br /> and has established codes to aid in carrying out this <br /> responsibility, and <br /> WHEREAS City Code .Chaptl';:lr;24 Emt:\.tled Sewer Department <br /> Regulations and Chapter 15, Artiqle'VTI, entitled Offensive <br /> Trades, and Metropolitan Sewer Board Rules and Regulations for <br /> the Metropolitan,DisposalSyste~ and the Minnl';:lsota Pollution <br /> Control Agency S"l;a'ndards 'all app:ty to the operation o'f The <br /> Mengelkoch Co. as a rendering business, and <br /> WHEREAS The City is aware and "has been' informed that certa in <br />." def;iciencies in the operation of the Mengelkoch Co. have occurred <br /> in the past with respect to these codes, rules, regulations and <br /> standards, and <br /> WHEREAS, odor emission tests performed at the Mengelkoch Co. <br /> in August, 1976 indicated odor emissions in excess of the limit <br /> allowed by Minnesota Pollution Control Regulations APC-9, and <br /> WHEREAS, an Offensive Trade License was issued to The <br /> Mengelkoch Co. in Resolution No. 1803A on December 14, 1976 on <br /> the basis of certain conditions, including conformance to <br /> APC-9, and <br /> WHEREAS, odor emission tests performed on July 25, 1977 <br /> at The Mengelkoch Co. indicated emissions of 200 odor units, <br /> which is a violation of APC-9, and <br /> WHEREAS, The City Council determined in Resolution No. 1911 <br /> that a plan and timetable for correction of odor pollution <br /> violations had to be prepared by the Mengelkoch Co. and <br /> submitted for City Council approval, and <br /> WHEREAS, The Mengelkoch Co. has prepared and submitted such <br /> plan, and <br /> WHEREAS, The deficiencies in the odor emissions from the <br /> Mengelkoch Co. affect the safety, health, welfare and well-being <br /> of the residents of the City of New Brighton, and <br /> WHEREAS, The deficiencies which previously existed in regard <br /> to disposal of sewage have, in the past, affected the safety, <br /> health, welfare and well~being of the City's residents in that <br /> such deficiencies cause plugging of the sanitary sewer and lift <br /> station, interference with sanitary sewer service to others, <br /> dumping of raw sewage on the open ground, and emission of <br /> offensive odors in the neighborhood, <br /> NOW THEREFORE BE IT RESOLVED, That the plan for correction <br /> of air pollution violations submitted by The Mengelkoch Co. is <br /> hereby approved. <br /> I <br />
