"' <br /> RESOLUTION NO. 1951 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE VN -175 <br />WHEREAS, an application for a variance VN-175 has been made <br />by Carl L. Kavolak, 2410 Violet Court, to permit the construction <br />of a garage having less than required front yard setback, and <br />WHEREAS the procedural history of the application is as <br />follows: <br />l. That an application for variance VN-175 was filed with <br /> the City on October 12, 1977 and was heard and reviewed <br /> by the Planning Commission at its meeting of October 18, <br /> 1977; <br />2. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing on October 25, 1977 to <br /> consider the application. All persons present at the <br /> hearing were given an opportunity to be heard; <br />3. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendations, <br /> and all person's statements made at the public hearing <br /> were considered. <br />NOW THEREFORE BE IT RESOLVED by the Council of the City of <br />New Brighton, that the Council hereby makes the following <br />findings of fact in respect to VN-175: <br />l. The circumstance unique to the application is the <br /> configuration of the lot and the location of the home <br /> on the lot; <br />2. That construction of the garage in a location other <br /> than proposed would constitute both aesthetic and <br /> economic hardship; <br />3. That given the orientation of the home on the lot, the <br /> intent of the zoning code in requiring a 30 foot front <br /> yard and 15 foot side yard is not being violated. <br />BE IT FURTHER RESOLVED, that the application for VN-175 is <br />and hereby approved. <br />Adopted this 25th day of October, 1977. <br />ATTEST: <br /> " <br />.-,"'''''' / \ <br />k~~l~d~. <br />Verr)l()n C.
