~f .'
. "'
RESOLUTION NO. 1951
STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON
RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE VN -175
WHEREAS, an application for a variance VN-175 has been made
by Carl L. Kavolak, 2410 Violet Court, to permit the construction
of a garage having less than required front yard setback, and
WHEREAS the procedural history of the application is as
follows:
l. That an application for variance VN-175 was filed with
the City on October 12, 1977 and was heard and reviewed
by the Planning Commission at its meeting of October 18,
1977;
2. That the City Council, pursuant to published and mailed
notices, held a public hearing on October 25, 1977 to
consider the application. All persons present at the
hearing were given an opportunity to be heard;
3. The written comments and analysis of the City Planner,
the Planning Commission minutes and recommendations,
and all person's statements made at the public hearing
were considered.
NOW THEREFORE BE IT RESOLVED by the Council of the City of
New Brighton, that the Council hereby makes the following
findings of fact in respect to VN-175:
l. The circumstance unique to the application is the
configuration of the lot and the location of the home
on the lot;
2. That construction of the garage in a location other
than proposed would constitute both aesthetic and
economic hardship;
3. That given the orientation of the home on the lot, the
intent of the zoning code in requiring a 30 foot front
yard and 15 foot side yard is not being violated.
BE IT FURTHER RESOLVED, that the application for VN-175 is
and hereby approved.
Adopted this 25th day of October, 1977.
ATTEST:
"
.-,"'''''' / \
k~~l~d~.
Verr)l()n C.
