<br /> .( ,~ <br /> . RESOLUTION NO. 1941 ! .. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION VACATING THAT PART OF 6TH STREET N.W. WEST OF 20TH <br /> AVENUE N.W. AND EAST OF 22ND AVENUE N.W. <br /> WHEREAS the City Council has been requested to consider <br /> the vacation of that part of 6th Street N.W. lying west of <br /> 20th Avenue N.W. and east of 22nd Avenue N.W., and <br /> WHEREAS the procedural history of the request is as <br /> follows: <br /> l. That a request from Mr. Robert W. O'Connell was received <br /> on June 9, 1977 and was heard and reviewed by the Planning <br /> Commission at its meeting of June 21, 1977: <br /> 2. That the City Council pursuant to published and posted <br /> notice, held a public hearing on July 26, 1977. All persons <br /> present at the hearing were given an opportunity to be <br /> heard: <br /> 3. The written comments and analysis of the City Planner, the <br /> Planning Commission minutes and recommendation, and all <br /> persons' statements made at the public hearing were <br /> considered. <br /> NOW THEREFORE BE IT RESOLVED that the Council of the City <br /> of New Brighton makes the following Findings of Fact in regards <br /> to this request: <br /> l. That the Board of Review has considered the vacation; <br /> 2. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing to consider the vacation; <br /> 3. That there are no plans to improve this section of 6th <br /> Street; <br /> 4. That there are no utilities in this section of 6th Street; <br /> 5. ~hat right of way is not used for walkways because of the <br /> presence of a pond; <br /> 6. Construction on the property would eliminate the pond that <br /> has caused a problem for surrounding property. <br /> BE IT FURTHER RESOLVED by the Council of the City of New <br /> Brighton that the following described street be and is hereby <br /> vacated: <br /> 6th Street N.W. from the west right-of-way line of <br /> 20th Avenue N.W. to the east right-of-way line of <br /> 22nd Avenue N. W. , lying south of Block 1, Haglunds <br /> Addition and north of the north line of Lot 1, <br /> Block 6, Hillview Acres Plat 3, extended to the <br /> west right of way line of 20th Avenue N.W. <br />
