<br /> " ~ "II! <br /> '~. <br /> l> , " <br /> .!",. 1938 <br /> RESOLUTION NO. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION AMENDING RESOLUTION NO. 1621, MAKING FINDINGS OF <br /> FACT AND APPROVING APPLICATION FOR NC-20 <br /> WHEREAS an application for a non-conforming use permit <br /> entitled NC-20 has been made by Tyson Truck Lines, Inc. , to <br /> amend the conditions of Resolution No. 1621 pertaining to the <br /> expansion of a building located at 185 5th Ave. SW, and <br /> WHEREAS the procedural history of the application is <br /> as follows: <br /> l. That an application for NC-20 was filed with the City on <br /> June 8, 1977 and was heard and reviewed by the Planning <br /> Commission at its meeting of June 21, 1977; <br /> 2. That the city Council, pursuant to published and mailed <br /> notices, held a public hearing on July 12, 1977. All <br /> persons present at the hearing were given an opportunity <br /> to be heard. <br /> 3. The written ccmwents and ana1ysis'of the City Planner, <br /> the Planning commission minutes and recommendations, and <br /> all person's statements at the public hearing were <br /> considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton <br /> city Council makes the followinS Findings of Fact in respect <br /> to the applica tJ.on for NC-20: <br /> l. Extensive effort has been made to bring the property <br /> more into conformance; <br /> 2. The impact, number and extent of Type IV non-conformities <br /> have beeh requced by additional landscaping in the front <br /> yard, by reduction of parking in the front yard, by <br /> addition of concrete curbing and by painting of the buildinq. <br /> BE IT FURTHER RESOLVED, That the application for NC-20 <br /> is hereby approved subject to the following conditions: <br /> l. Compliance with amended site plan dated July 12, 1977 ! <br /> I <br /> signed by the applicant and the City Planner; <br /> 2. Employee and visitor parking being restricted to the site <br /> alone and not allowed on 5th Avenue SW; <br /> 3. The refuse enclosure be moved to a location not visible front <br /> the public street; <br />
