<br /> - <br />~. la; <br /> RESOLUTION NO. 1902 <br />. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br />FOR NON-CONFORMING USE PERMIT, NC-22 <br /> WHEREAS an application for a non-conforming use permit <br />entitled NC-22 has been made by the Salem Covenant Church to <br />permit the expansion of the building located at 2655 5th St. NW,. <br />and <br /> , <br /> WHEREAS the procedural history of the application is <br />as follows: <br />1. That an application for NC-22 was filed with the City on <br /> June l5, 1977, and was heard and reviewed by the Planning <br /> Commission at its meeting of June 21, 1977; <br />2. That the City Counci1~ pursb.a'nt to', pub'1ished and mailed <br /> notices, held a public hearing on July 12, 1977. All <br /> persons prese~:t a:t the heal.ring ware given an opportunity <br /> to be heard~. <br />3. The written comment.s antlana1ysis of the City Planner, <br /> the Planning Commission minutes and recommendations, and <br /> all person's statements made at the public hearing were <br /> considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to the <br />application for NC-22: <br />1. The impact and extent of Type IV non-conformities will <br /> be reduced by additional landscaping around the parking <br /> lot. <br />2. Providing additional off-street parking will benefit the <br /> public health and safety. <br /> BE IT FURTHER RESOLVED, That the application for NC-22 <br />is hereby approved. <br /> BE IT FURTHER RESOLVED, That the approval of non-conform Lng <br />use permit NC-22 is subject to the following conditions: <br />1. The landscaping along the church western property line <br /> be coordinated with the development of the 5th Street <br /> park; <br />2. That a landscape plan showing p1antings along 5th St. NW <br /> and Silver Lake Road be submitted to the Council for <br /> review prior to the issuance of any certificate of <br /> occupancy. <br />3. That proper erosion control methods, including the spreadintj <br /> of mulch over exposed areas, be implemented during <br /> construction; <br />
