<br />. 4' .. - t <br />,. <br /> RESOLUTION NO. 1891 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACTS AND APPROVING <br />APPLICATION FOR VN-171 <br /> WHEREAS an application for a variance entitled VN-171 has <br />been made by Cobb, Inc. , to permit construction of a home <br />on Lot 7, Block 1, Valley View Addition with less than a <br />thirty (30) foot front yard setback, and <br /> WHEREAS the procedural history of the q.pp1ication is as <br />follows: <br />1. That an application for VN-171 was filed with the City <br /> of May 11, 1977 and was heard and revi~wed by the <br /> Planning Commission at it~ meeting of. May 17, 1977; <br />2. That the City Council, pursuant to ,pub.1ished'and <br /> mailed notices, heLd ~ puh1ic hearin9fon JUne, 14, 1977 <br /> to consider the application. All persons present <br /> at the hearing were given an opp.oY'tunity to be heard. <br />3. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendation, <br /> and all person's statements made at the public hearing <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br />Council makes the following Findings of Fact in respect to <br />the application for VN-171: <br />1. That the situtation is unique because of the steep <br /> slope on the lot and because the street was constructed <br /> at a higher elevation than anticipatedt <br />2. That there is hardship because it would be uneconomical to <br /> construct a home on the lot with the required setbackt <br />3. That the Council has granted other similar setback <br /> requests on property with steep slopes; <br />4. That the granting of the variance would not constitute <br /> special privilege because a house could be built on the <br /> property even without a variance; <br />5. That the lot is located at the end of a low traffic <br /> volume cul-de-sac which minimizes the impact of the <br /> variancet <br />II <br />
