<br />..,~ <br /> <br />i. <br /> <br /> <br />RESOLUTION No. 03-011 <br />STATE 'OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />, ' <br /> <br />I RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF SP03-02. <br /> <br />WHEREAS, an application for a Special Use Permit by Pratt Ordway Properties for an amended sign plan <br />for Main Street Village; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br /> <br />1. In May of2001, an application for a special use permit was filed with the City of New <br />Brighton for the Main Street Villaged signs. The Planning Commission held a public hearing <br />on May 15, 2001and unanimously recommended approval subject to conditions to the <br />Council. On May 22,2001 the Council approved the Special Use Permit (Resolution 01- <br />044). <br />2. An application for a special use permit was filed with the City of New Brighton on January 2, <br />2003 to amend the approved Sign Plan. <br />3. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />January 21,2003; and all persons present at the hearing were given an opportunity to be <br />heard. <br />4. The Planning Commission voted and unanimously approved the Special Use Permit. <br />5. The City council considered the application on January 28,2003. <br /> <br />. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of <br />Fact in respect to SP 03-02: <br /> <br />i. <br /> <br />1. <br />2. <br /> <br />The subject site is zoned B-4, Downtown Business. <br /> <br />Amending the approved Sign Plan for Main Street Village (Resolution 01-044) requires a <br />Special Use Permit. As specified in Section 8-130 ofthe New Brighton Zoning <br />Ordinance, no special use shall be approved by the Planning Commission unless such <br />shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br />b. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantially diminish and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in <br />the district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been <br />or are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable <br />regulations of the district in which it located. <br /> <br />3.
