<br /> '" <br />-:, ,. <br /> .. -. <br /> , ' , <br />< <br />. 1859 <br /> RESOLUTION NO. <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VN-167 <br /> WHEREAS an application for VN-l:67 to permit the continuing <br /> use of a trailer as a supplemental office has been made by the <br /> MacGillis & Gibbs Company, and <br /> WHEREAS the procedural history of the application is as fol- <br /> lows: <br /> 1. The application for VN,.J.67 was filed with the City of <br /> Nove,:rnber 9, 1976: <br /> 2. The City Council, pursuant to published and mailed <br /> notice held a,hearing on December 28,1976, at which time <br /> the variance was considerep1 <br /> 3. The applicant and other persons present at the hearing <br /> were given an opportunity to be heard: <br /> 4. The written comments and analysis of the Building and <br /> Planning Department and the Planning Commission minutes <br /> and recommendations and all person's statements at the <br /> public hearing, including the statements of the <br /> applicant were considered by the Council at said hearin~. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to the <br /> application for VN-167: <br /> 1. That the MacGillis & Gibbs poleyards are a unique use <br /> not heretofore legislatively contemplated; <br /> 2. That no special privilege would accrue to the property <br /> as a result of approval of the variance in that the <br /> trailer is not visible from a public roadway and in <br /> that such trailer would be a temporary rather than a <br /> permanent use: <br /> 3. That hardship exists because of the need for officing <br /> space: <br /> 4. That alterations can be made to the site reducing <br /> the impact of: non- conformities. <br /> BE IT FURTHER RESOLVED, That based on the above Findings of <br /> Fact the application for VN-167 be and is hereby approved. <br /> BE IT FURTHER RESOLVED, That such approval be conditioned <br /> on: site and <br /> 1. Compliance with the/landscape plan dated 3/16/77 <br /> signed by the Building and Planning Coordinat6r, ',.such <br /> landscaping to be completed by July 1, 1977. <br />
