<br />'t .~~ .. ..' .. <br /> .4 RESOLUTION NO. 1858 <br />. - <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br /> VN-170 <br /> WHEREAS an application for variance entitled VN-170 has been <br /> made by Dahlke Trailer Sales and Leasing, Inc. , to allow erection <br /> of signs exceeding Zoning Code requirements, and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> l. That an application for VN-170 was filed with the <br /> city on February 9, 1977, and was heard and reviewed <br /> by the Planning Commission at its meeting of <br /> February 15, 1977~ <br /> 2. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing on March 8, 1977 to <br /> consider the application. All persons present at the <br /> hearing an opportunity to be heard. <br /> 3. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendations, <br /> and all persons' statements made at the public <br /> hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to the <br /> application for VN-170: <br /> 1. The recommended action does not grant Dahlke Trailer <br /> Sales special privilege because the sign ordinance <br /> anticipated the front of the building being the face <br /> with the major dimensions. The applicant's building <br /> has its front on the narrow side of the building, <br /> thereby creating a small signable area. <br /> 2. The location and shape of both the property and building <br /> present unique circumstances regarding signing. <br /> The property being situated near 1-694, I-35W and Old <br /> Highway 8 and the building having large setbacks from all' <br /> roads also presents unique circumstances. Further, the <br /> narrow side of the building is the front side, which <br /> was not anticipated by the ordinance. <br /> 3. A hardship exists for the signing of this property by <br /> reason of the unique circumstances noted above. <br /> BE IT FURTHER RESOLVED, That the application for VN-170 be <br /> hereby approv~d for signing at 1155 Old Highway 8. <br /> BE IT FURTHER RESOLVED, That the variance approved is subject <br /> to the following conditions: <br />
