RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br /> VN-168 <br /> WHEREAS an application for VN-168 to permit the enlargement <br /> of a parcel of land not having public access has been made by <br /> Herbst and Sons Construction Company, Inc. and by Bernice Skiba, <br /> and <br /> WHEREAS the procedural history of the application is as <br /> follows: <br /> 1. The application for VN-168 was filed with the City on <br /> Dece,mber 16, 1976. <br /> 2. The city Council, pursuant to published and mailed <br /> notice held a hearing on January 25, 1977, at which time <br /> the variance was cons id ered. <br /> 3. The written comments and analysis of the Department of <br /> community Development and the Planning Commission <br /> minutes were considered by the Council at said hearing. <br /> 4. The applicant and other persons present at the hearing <br /> were given an opportunity to be heard and their state- <br /> ments were considered by the Council. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to the <br /> application for VN-168: <br /> Findinqs of Fact <br /> 1. That the location and shape of Parcel A (as described in <br /> the attached subdivision resolution) is such tha t access <br /> to parcel 2 (as described in the attached subdivision <br /> resolution) cannot be provided except by moving the house <br /> on Parcel A, which would constitute a hardship. <br /> 2. That the variance s~tisfies t~ intent of the platting <br /> regulations in that no new landlocked parcels are <br /> created, and the conditions noted below provide for the <br /> pote~tiality of future public access wbich helps to <br /> alle\riate the access problem. . <br /> BE IT FURTHER RESOLVED, That based upon the above Findings <br /> of Fact the application,forVN-168 be and is hereby approved with <br /> the following conditions: <br /> 1. That the owners of Parcel 1 and Parcel 2 (as described <br /> in the attached subdivision resolution) execute a quit <br /> claim deed dedicating a thirty ( 30) foot public road <br /> easement along the north property line of parcels <br /> 1 and 2 to the City of New Brighton. <br />
