<br />. . <br /> . <br />.' <br /> - <br />~.. ~ <br /> RESOLUTION NO. 1843 <br /> / <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VN-165 <br /> WHEREAS an application for variance entitled VN-165, being <br /> a variance to allow subdivision of property with lots having less I <br /> than the minimum lot frontage on a public street and less than <br /> the minimum width at the building setback line, has bee~made to <br /> the City and said application has been processed and reviewed <br /> by the Planning Commission at its meeting on October 19, 1976, <br /> and heard and considered by the Council at a public hearing on I <br /> I <br /> November 9, 1976. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> VN-165: <br /> Findinq of Fact <br /> 1. That an application for VN-165 was filed with the <br /> City on October 15, 1976, and was heard and reviewed <br /> by the Planning Commission at its meeting of <br /> October 19, 1976; <br /> 2. That the City Council, pursuant to published and <br /> mailed notices, h~ld a hearing on November 9, 1976, <br /> to consider the applicqtion. Tbe applicant and other <br /> persons present at the hearing were given an opportunity <br /> to be heard; <br /> 3. The written comments and analysis of the City Planner, <br /> the Planning Commission minutes and recommendations <br /> and all personsl statements made at the public hearing <br /> were considered including the statements of the applicani: <br /> and members of the Council. <br /> BE IT FURTHER RESOLVED, That the application for VN-165 be <br /> approved for the following reasons: <br /> 1. That undue hardship exists because to not allow sub- <br /> division would mandate that a lot ten times larger <br /> than the City lot area requirement would have to exist. <br /> 2. That unique circumstances exist because of the <br /> combination of the unusual shape and large size of the <br /> parcel. <br /> 3. That the trees on the eastern property line mitigate <br /> the impact of the variance. <br />
