<br />II <br />:~ <br /> <br />'. <br /> <br />J <br /> <br />RESOLUTION No. 03-010 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING ofNC02-6, SP02-14, and LP02-12. <br /> <br />WHEREAS, an application has been made by Mina Adsit, Architect on behalf of Benedictine Health <br />System for a Nonconforming Use Permit and Site Plan Review to construct an addition <br />onto the existing Innsbruck Health Care Center building at 2800 I-694 Service Drive; <br />and <br /> <br />,; WHEREAS, the procedural history of the application is as follows: <br /> <br /> 1. <br />, 2. <br /> : <br />, : <br /> 3. <br /> <br />An application for a nonconforming use permit was filed with the City of New Brighton on <br />January 2,2003. <br />The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on January 21, 2003 and all present were given a chance to freely speak at the hearing; <br />The City Council considered the request on January 28,2003; and, <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />to NC02-6, SP02-14, and LP02-12: <br /> <br /> l. <br /> 2. <br /> 3. <br />, , 4. <br /> 5. <br /> <br />, : <br /> <br />The subject site is zoned R-3B, Multi-family Residential and the future laud use is P-QP, <br />Public-Quasi Public. <br /> <br />Both the Zoning Code and Comprehensive Plan support the use existing and proposed for <br />the site. <br /> <br />The applicant is proposing to construct an addition onto the existing building at 28001-694 <br />Service Drive. <br /> <br />Required screening of off street parking areas along the east lot line is not provided for and <br />the south parking area and southwest comer of the existing building encroach into the front <br />yard setback; all three are Type 4 Non-conformities. <br /> <br />As specified in Section 8-610 of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconforming Use pennit shall be granted unless one or more of the following conditions <br />are met : <br /> <br />a. The total number of nonconformities is reduced. <br /> <br />b. The impact of any nonconformities upon adjacent premises is reduced to the greatest <br />practical extent. <br />c.
