<br />. <br /> ...- " . <br />-' . <br />r , . <br /> RESOLUTION NO. 2113 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE <br /> VACATION OF A WALKWAY EASEMENT (Generally that part of the <br /> vacated 3rd Street S.E. retained as a walkway easement). <br /> WHEREAS, a request to vacate a walkway easement located <br /> between lst Avenue S.E. and 2nd Avenue S.E. has been made by <br /> Joseph Jansen and whereas the Board of Review has recommended <br /> that the vacation of the walkway easement located between <br /> 2nd Avenue S.E. and New Brighton Road also be considered, <br /> and, <br /> WHEREAS, the procedural history of the request is as <br /> follows: <br /> 1. That Joseph Jansen has requested, by lettel;' , that <br /> the walkway easement between lst Avenue S.E. and <br /> 2nd Avenue S.E. be vacated. <br /> 2. That the Board of Review considered the request at <br /> their meeting of September 19, 1978 and has <br /> recommended the vacation of the walkway easement <br /> between 2nd Avenue S.E. and New Brighton Road in <br /> addition to recommending approval of the vacation <br /> requested by Mr. Jansen. <br /> 3. That at its September 26, 1978 meeting the City <br /> Council did initiate the vacation of the entire <br /> 3 block walkway easement. <br /> 4. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on October 24, <br /> 1978 to consider the proposed vacation. A II person IS <br /> present at the hearing were given an opportunity to <br /> be heard. <br /> 5. That the written comments and analysis of the <br /> Director of Community Development, the Board of <br /> Review recommendation and all person's statements <br /> made at the public hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the <br /> City of New Brighton that the following Findings of Fact are <br /> made in respect to the request: <br /> 1. That a 30 foot walkway and utility easement was <br /> retained at the time 3rd Street S.E. was vacated. <br /> 2. That there are both above and below ground utilities <br /> within the easement. <br />
