<br />... -, I <br />I <br />"--- <br /> RESOLUTION NO. 2108 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> OF NON-CONFORMING USE PERMIT NC-33. <br /> WHEREAS, an application for a non-conforming use permit <br /> NC-33 has been made by Micom Corporation, 475-8th Avenue, to <br /> permit the construction of a building addition~ and <br /> WHEREAS, the procedural history of the application is as <br /> follows: <br /> 1. That an application for a non-conforming use permit <br /> NC-33 was filed with the City on September l5, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting on September 19, 1978. <br /> 3. That the city Council, pursuant to published and <br /> mailed notices, held a public hearing on <br /> October 10, 1978 to consider the application. All <br /> person's present at the public hearing were given an <br /> opportunity to be heard. <br /> 4. The written comments and analysis of the City Planner <br /> and all person's statements made at the Board of <br /> Review meeting were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton that the follow inq Findings of Fact are made <br /> in respect to NC-33. <br /> 1. That the property is zoned 1-2, Heavy Industrial. <br /> 2. That the following Type IV non-conformities have been <br /> identified on the property: <br /> a. Less than 40 foot front yard setback. <br /> b. Less than a l5 foot side yard setback. <br /> c. Front and side street yards are not landscaped. <br /> d. Front and side street yards are used for parking. <br /> e. There is parking within l5 feet of a street <br /> right-of-way. <br /> f. There is no concrete curbing around the parking <br /> areas in yards abutting streets. <br /> g. There are 3 driveways. <br /> h. The northern most driveway is loca ted less than <br /> 50 feet from the street right-of-way intersection. <br /> 3. The site and landscape plans submitted indicate that <br /> the following improvemen ts would be made: <br /> a. The front yard would be totally landscaped and <br /> not used for parking. <br /> b. That parking in the side street yard would be <br /> reduced and additional landscaping provided. <br /> c. That all required concrete curbing would be <br /> provided. <br /> d. That one ( 1) driveway would be closed. <br /> e. That the northern driveway along 8th Avenue <br /> would be moved somewhat to the south so as to <br /> be further from the street right-of-way intersec- <br /> tion. <br />
