RESOLUTION NO.2088 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE <br /> APPLICATION VN-l92. <br /> WHEREAS, an application for a variance VN-192 has been <br /> made by Shirley and Robert M. Erwin, to permit a subdivision <br /> of property creating lots less than 75 feet in width, and <br /> creating a side yard setback of less than the required <br /> five (5) feet, and <br /> WHEREAS, the procedural history of the application is <br /> as follows: <br /> 1. That an application for a variance VN-192 was <br /> filed with the City on August 8, 1978. <br /> 2. That the Board of Review heard and reviewed the <br /> application at its meeting on August l5, 1978. <br /> 3. That the City Council, pursuant to published <br /> and mailed notices, held a public hearing on <br /> September 14, 1978, to consider the application. <br /> All person's present at the hearing were given <br /> an opportunity to be heard. <br /> 4. The written comments and analysis of the City <br /> Planner, the Planning Commission Minutes and <br /> recommendation and all person's statements <br /> made at the public hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> of New Brighton, that the following Findings of Fact are made <br /> in respect to VN-l92. <br /> 1. That the property has some uniq~e characteristics <br /> including size, shape, locations, topograph, a creek <br /> which flows through the property and a sewer easement <br /> which crosses the property. <br /> 2. That the property characteristics create a hardship <br /> in subdividing this property into lots meeting all <br /> zoning code requirements. <br /> 3. That the lots proposed greatly exceed the minimum lot <br /> area required for a R-l District. <br /> 4. That the variances requested are minimal and have <br /> little impact in relationship to the property size <br /> and orderly subdivision of the property. <br />
