" <br /> ~ <br />'.. <br /> RESOLUTION NO. 2075 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE <br /> APPLICATION VN-189. <br /> WHEREAS, an application for a variance VN-l89 has <br /> been made by Rollin Hansen to permit construction of a home <br /> with less than the required thirty (30 ) foot front yard set- <br /> back, and <br /> WHEREAS, the procedural history of the application is <br /> as follows: <br /> 1. That an application for a variance VN-189 was <br /> filed with the City on July 12, 1978. <br /> 2. That the Board of Review heard and reviewed <br /> the application at its meeting on July 31st, 1978. <br /> 3. That the City Council pursuant to published and <br /> mailed notices, held a public hearing on August 8, <br /> 1978, to consider the application. All persons <br /> present at the public hearing were given an <br /> opportunity to be heard. <br /> 4. The written comments and analysis of the City <br /> Planner, the Planning Commission minutes and <br /> recommendation, and all persons statements made <br /> at the public hearing were considered. <br /> NOW THEREFORE BE IT RESOLVED by the Council of the <br /> city of New Brighton that the following Findings of Fact <br /> are made in respect to VN-l89: <br /> 1. That the property is zoned R-1, Single Family, <br /> which requires a thirty (30) foot front yard <br /> setback. <br /> 2. That the development of this lot has been affected <br /> by the construction of an offset cul-de-sac and <br /> the construction of a sound barrier. <br /> 3. That the conditions noted in 2. above have created <br /> unique circumstances pertaining to development <br /> of the lot. <br /> 4. That conforming to ordinance requirements creates <br /> problems forboth the design and location of a home. <br /> 5. That construction of a home meeting setback <br /> requirements could impact the privacy and <br /> desirability of the subject lot as well as that <br /> of the adjacent property. <br />
