, j
" - -,
RESOLUTION NO. 2062
STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON
RESOLUTION MAKING FINDINGS OF FACT AND DENYING VARIANCE
APPLICATION VN-184
WHEREAS, an application for a variance entitled VN-l84
has been made by Mr. Keith T. Harstad to permit construction
of a home having a basement elevation less than three (3 )
feet above adjacent high water 1eve 1, and
WHEREAS, the procedural history of the application is as
follows:
1. That an application for VN-184 was filed with the
City on May 10, 1978 and was heard and reviewed
by the Planning Commission at its meeting of May 22,
1978;
2. That the City Council, pursuant to published and
mailed notices, held a public hearing on June 13,
1978 to consider the application. All persons
present at the hearing were given an opportunity
to be heard;
3. The written comments and analysis of the City
Planner, the Planning Commission minutes and
recommendation, and all person's statements
made at the public hearing were considered.
NOW THEREFORE BE IT RESOLVED by the Council of the City
of New Brighton, that the Council makes the following findings
of fact in respect to VN-184:
l. That the city should not allow the house to be
built at the requested elevation because of the
potential drainage problems with the storm sewer
system.
2. That there is a possibility of opening the City to
problems down the line and because of a possible
flooding of basements;
3. That the developer should meet the code;
