<br />" f ..1 <br /> <br />, <br />, <br />, RESOLUTION NO. 2059 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND STATING THAT UNDER <br />CERTAIN CONDITIONS A PLUMBING RETAIL AND CONTRACTING SHOP <br />IS A PERMITTED USE WITHIN A B-3 DISTRICT. <br /> <br />WHEREAS, De - K Mechanical has requested permission to <br />use the building located at 721-723 5th Avenue N.W. for a <br />plumbing retail and contracting shop, and <br /> <br />WHEREAS, the New Brighton Zoning Code does not clearly <br />prohibit such use, and <br /> <br />WHEREAS, the City Council has investigated the facts <br />relating to such request and heard all relevant arguments <br />on the subject. <br /> <br />NOW THEREFORE BE IT RESOLVED by the Council of the City <br />of New Brighton that the following findings of fact are made <br />in regard to the request of De - K Mechanical: <br /> <br />1. The property is currently zoned B-3, General Business <br />District. <br /> <br />2. That retail businesses are a permitted use in a B-3 <br />District. <br /> <br />3. That a business type structure exists on the property <br />and business type uses have been conducted on the <br />property for many years. <br /> <br />4. That the applicant will use the property for a retail <br />plumbing store and a plumbing contracting business. <br /> <br />5. That the retail plumbing business will consist of <br />selling plumbing supplies with displays of plumbing <br />fixtures and will occupy approximately three-fourths <br />of the building. <br /> <br />6. That the contracting business will be primarily office <br />space with some material storage in the rear of the <br />building. <br /> <br />7. That the only large equipment consists of two van type <br />trucks. <br />
