J -... .~.. l" '\ " -2- BE IT FURTHER RESOLVED, That the application f.Qr PRD #25 is and hereby approved subject to the following conditions: I. That an emergency and maintenance access easement be provided to permit access to the common grea. 2. That all grading, drainage, utilities and fire hydrants be subject to approval of the city engineer. 3. That the application provide an easement for the oil pipeline acceptable to the City Council prior to approval of the final PRD. 4. That all boundary line setbacks be observed. 5. That the access easement to the common area be marked. 6. That the housing shall be designed to provide for a variety of architectural styles and that no one floor plan shall occur on over 30% of the homes within the PRD. 7. That the area be graded to allow for complete run-off into the proposed sewer and that the sewer be extended into the common area. 8. That the common area be landscaped or at least graded to the point that all hazardous material (cement, reinforcing rods, etc. ) will be buried sufficiently deep to eliminate all future hazards from this material. 9. That a homeowners association be established and that common area be encumbered in such a way that the taxes will be assessed with the homeowners property to eliminate the possibility that the common area could revert to the city because of non-payment of taxes. 10. That the proposed grading and sewer will handle water situations for the entire area, and that the completed project will meet all proposals. II. That the contractor see that all clean up ordinanG€s will be followed and all debris and litter will be removed from the site as soon as is feasible. 12. That the pipeline location be defined and will not create any problems to the builder or residents. 13. That applicant agrees to provide easement south of the current pipeline for purposes ofeonstruction of a cul-de-sac if any when the city should determine that should he 'done.
