<br /> I <br /> I <br />" I <br />.. ..... , <br /> I ~ -" <br />.. <br /> I <br />". ,.... <br /> RESOLUTION NO 2277 f <br /> I <br /> STATE OF MINNESOTA I <br /> ! <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND ORDERING THE RAZING OF <br /> A HAZARDOUS BUILDING <br /> WHEREAS, The property legally described as Lot 5, Block 1 , <br /> Vescio's 3rd Addition and with an address of 1667 - 3rd Street <br /> S. W. has an unfinished building in a deteriorated, hazardous <br /> I' and unsightly condition, and <br /> Ii <br /> ! ~ WHEREAS, The following findings of fact are made in I <br /> I <br /> I regard to the above described property: <br /> ! <br /> l. That a building permit, #5615, was issued to <br /> I Norman Lindner on September 30, 1976 permitting <br /> , construction of a single family dwelling. <br /> 2 . Construction commenced with a basement and floor I <br /> system being installed. , <br /> I <br /> 3. Construction was discontinued and the partfally I <br /> built dwelling became unsightly and a hazard to I <br /> r the neighborhood. I <br /> 4. Gerald A. Nye, G. N. Investments, 301-81st Avenue 1 <br /> I <br /> II North, Minneapolis, Minnesota 55444, then I <br /> II apparently acquired the property though the <br /> Ii construction was not completed. <br /> II 5 . After proper notice and allowance of time the <br /> I, City of New Brighton charged Mr. Nye with a <br /> i' <br /> II public nuisance in regard to the hazardous <br /> condition of the property. Mr. Nye appeared in <br /> Ii District Court October 18, 1978 upon which an <br /> order was issued to a~ate the nuisance. This <br /> court order was complied with and the charge was I <br /> II dismissed on January 29, 1979. <br /> I, I <br /> " 6. G. N. Investment then proceeded to commence once <br /> II <br /> II again the construction of the dwelling. Some <br /> rough framing and outer sheathing was put up. <br /> 'i At this point construction was again halted and <br /> I <br /> I the property abandoned. <br /> I <br /> I 7. The partially constructed building has deteriorated <br /> II to a point of being hazardous, unsightly and I <br /> 'I detrimental to the neighborhood which inlcudes a I <br /> substantial number of children. I <br /> 8. That the administrative staff has made repeated <br /> ,I efforts to contact the builders in the hope of <br /> completing this project. Such efforts have not <br /> however succeeded in a resolution of this <br /> hazardous and unsightly situation. <br /> 9 . That the length of time transpired since original <br /> I permit issuance and accompanying events of the <br /> \1 situation lead to the conclusion that completion I <br /> I, <br /> I of the project in its present form is impossible. <br /> 10. That the property clearly is unsightly, detrimental <br /> J to surrounding property values and constitutes <br /> ! a re a 1 hazard in its present unfinished stage. <br /> I I <br /> i NOW THEREFORE BE IT RESOLVED by the Council of the City <br /> I of New Brighton that based on the above Findings of Fact the <br /> I <br /> I owners of Lot 5, Block 1, Vescio's 3rd Addition, 1667 3rd <br /> I Street S.W., are and hereby ordered to take all necessary <br /> I actions to raze the partially constructed dwelling, fi 11 in <br /> I the basement and grade the site so as to restore it to a <br /> sateeabdb~anitaty.state. <br /> I <br />
