A draft AUAR of the Redevelopment Site was prepared and was distributed for <br />comments, as required by Minnesota Rules Ss 4410.3610 subp. 5(A) and <br />4410.1500. <br /> <br />H. The required 30-day public comment period commenced October 28, 2002, and <br />concluded November 27,2002. During that time, the City received comments on <br />the draft AUAR from the Minnesota Department of Transportation, the Minnesota <br />Department of Natural Resources, the Metropolitan Council, the Minnesota <br />Historical Society, the Rice Creek Watershed District, and from a resident, Terry <br />Post. <br /> <br />, 1. On November 26, 2002, City Staff, counsel for the City, and the consultant <br />retained by Ryan to assist in preparing the AUAR appeared at an open house to <br />answer any questions that citizens may have had on the AUAR. On the same <br />evening, City Staff and the consultant for Ryan made a presentation to this <br />Council explaining the AUAR process and the draft AUAR for the <br />Redevelopment Site. <br /> <br />J. Based on all comments received during the public comment period, a Final <br />AUAR and Mitigation Plan were prepared. <br /> <br />, K. On December 17,2002, this Council approved distributing the Final AUAR <br />together with the required Mitigation Plan, to all persons who commented on the <br />draft AUAR and to the staff of the Environmental Quality Board, as required by <br />Minnesota Rules S 4410.3610 subp. 5(D). <br /> <br />; L. At the conclusion of the 1 O-day public comment period required under Minnesota <br />Rules S 4410.3610 subp. 5(D), the City had received comments only from the <br />Metropolitan Council in a letter dated January 6,2003 and from the U.S. Army <br />Corps of Engineers in a letter dated December 24,2003. The Metropolitan <br />Council took no formal action on the AUAR and stated that its review ofthe <br />AUAR had concluded. The U.S. Army Corps of Engineers concurred with the <br />AUAR's statement that prior to development, further investigation pertaining to <br />the possible wetland boundaries at the Redevelopment Site should be undertaken. <br />Neither agency objected to the final AUAR or the Mitigation Plan. <br /> <br /> <br />NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF NEW BRIGHTON: <br /> <br />1. That the Final AUAR and Mitigation Plan dated December 20, 2002, of <br />the Redevelopment Site meets all applicable requirements set forth in Minnesota <br />Statutes Chapter ll6D and Minnesota Rules chapter 4410. <br /> <br />- 2 - <br />
