Jacobson, Director of Public Safety, <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this <br />Recommendation: <br />Comments attached <br />Approval of Resolution and Consent Order Imposing a Civil Penalty of $1,000 for Cub Foods. <br />Legislative History: <br />mrn: <br />Financial Impact - <br />0 Civil penalty of $1,000 will be received within 10 days. <br />Explanation: <br />The City of New Brighton conducts alcohol compliance checks twice per year. The goal of <br />conducting compliance checks is to reduce the availability of alcoholic beverages to those who <br />are under the age of 21. <br />Cub Foods sold alcoholic beverages to a buyer under the age of 21 during police supervised <br />compliance checks on July 10, 2007. The employee who sold during those compliance checks <br />has been convicted of criminal charges for those violations. <br />I have communicated with Mr. Paris Fadden, Store Director for Cub Foods of New Brighton. <br />Mr. Fadden has demonstrated remorse for the sale of alcoholic beverages by his staff. Further, <br />Mr. Fadden has retrained his staff, further implemented policy for reducing the likelihood of a <br />further violation, and now requires a supervisor to approve the sale of alcohol. Mr. Fadden has <br />signed a Consent Order in which he agrees to pay a civil penalty of $1,000 as required by City <br />Code and agrees to follow through with practices to eliminate sale of alcoholic beverages to <br />those under the age of 21 in his business. <br />Robert J.
