STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />ORDINANCE NO. <br />AN ORDINANCE RELATING TO CRIMINAL HISTORY BACKGROUND <br />CHECKS ON APPLICANTS FOR EMPLOYMENT AND LICENSES; <br />ADDING ARTICLE 6, SECTIONS 23-70 -- 23-72 <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS that Article 6, <br />Sections 23-70 — 23-72 are added to the City Code of Ordinances as follows: <br />Article 6. Criminal History Background <br />Sec. 23-70. Investigation. <br />The New Brighton Public Safety Department is authorized to conduct a criminal history <br />background investigation on applicants for employment and licenses with the City. This section <br />applies only to applicants who are finalists for paid or volunteer positions or who are applicants <br />for City licenses. Before the investigation is undertaken, the applicant must provide written <br />authorization to the Public Safety Department to conduct the investigation and to release the <br />information to the City Council, City Manager and other City staff as appropriate. <br />Sec. 23-71. Denial of Employment or License. <br />Subject to the exceptions in Minnesota Statutes, section 364.09, the City may deny an applicant's <br />request for employment or a license solely or in part due to a prior conviction of a crime or <br />crimes if the crime or crimes directly relates to the position of employment sought or the <br />occupation for which the license is sought. <br />Sec. 23-72. Notice to Applicant. <br />If the City rejects an applicant's request for employment or a license due solely or in part to a <br />prior conviction of a crime, the City Manager will notify the applicant in writing of the <br />following: <br />(1) the grounds and reasons for the denial or disqualification; <br />(2) the applicable complaint and grievance procedure as set forth in Minnesota Statutes, section <br />364.06; <br />(3) the earliest date the applicant may reapply for a position of public employment or a license; <br />and <br />10 (4) that all competent evidence of rehabilitation presented will be considered upon reapplication. <br />
