The existing detached garage is removed, <br />2. The proposed 20' x 36' garage meets a 5' setback from the side lot line, and <br />3. The garage may not be used for a commercial or home occupation activity. <br />Legislative History: August 19, 2008: The Planning Commission considered the request and held a <br />public hearing. No public testimony was given. The Commission voted unanimously to approve the <br />request as submitted. <br />Financial Impact: None <br />Explanation: The applicant is requesting consideration of a Special Use Permit to allow construction of <br />a new detached garage in excess of 624 SF at 2871 14th Street NW. The property currently contains a <br />20' x 26' detached garage at a side yard setback less than the required 5'. With this proposal the <br />existing garage would be removed and a new 20' x 36' garage would be constructed in generally the <br />same location, but meeting the required 5' side yard setback. Lastly, the existing driveway would be <br />utilized for access to the proposed garage. <br />Staff considered the request against the special use standards of Section 4-530 and 8-130 and found all <br />criteria to be met. A full analysis of these standards is provided in the attached Planning Report.
