The New Brighton City Code is amended by adding a new Chapter 33 as follows: <br />i± <br />City Code <br />Chapter 33 <br />so <br />i. <br />Street Lighting System <br />See. 3$•1. Statutory Authority. <br />Minngsota Statutes, Section 429.101 authorizes cities to impose charges for the cost of operating a <br />streets ighting system and to adopt an ordinance to make this authority effective. By this Chapter, <br />the Cil;y of New Brighton elects to exercise this authority. <br />t' <br />Sec. $3-2. Street Lighting System Established. <br />A cit street lighting system is established_ The system consists of all street lighting facilities <br />' y gh <br />ownelo by the city and all street lighting facilities for which the city purchases and supplies electrical <br />Sec. b-3. Rates and Collection of Fees, <br />(1) Rtes. The street lighting charges imposed by this Chapter will be based on land use. The City <br />Courlpil will establish a flat rate for single and two-family residential properties and a flat rate for all <br />otherlperty categories within the City's billing system_ Unimproved and vacant land will not be <br />Mlle for street lighting under this Chapter. <br />(2) (�lcutation of Rates. The City Council will adopt a Resolution establishing the rate of the <br />servide charge for each property category. <br />(3) 41jection of Fees. Street lighting charges will be placed directly on the quarterly utility bill for <br />NW. 34950 <br />NEM 191 <br />
